Planning Appeal Process
1 Once our client has instructed our services for a Planning Appeal.
2 We will collect all client information provided and associated documents related to the application we are appealing.
3Prepare bespoke Statement of Case detailing how the proposal is policy compliant.
4 We will now make a start on undertaking background research on your case.
5 Once this has been completed, we will then commence work on the draft copy of your Appeal.
6 An electronic version will be sent to you once it has been completed.
7 Once you have agreed that you are happy with the Appeal Statement the appeal will be lodged with the Planning Inspectorate using their online platform.
8 Planning Inspectorate confirms receipt of appeal documents (we send details to you)
9 We notify the Council of the appeal.
10 Upon submission, we will receive a unique appeal reference number, that we will forward to you.
11 Shortly thereafter we will receive a validation letter and once a Planning Inspector become available, we will receive a start date letter setting out the timetable for your appeal.
12 Inform client of site visit date
13 We will endeavour to keep you fully informed of the progress of your appeal and guide you through every step of the process.
14 Liaise with the Planning Inspectorate and the Council on any matters.
15 Prepare any final comments that are required to rebut any claims made by the Council in their Statement of Case.
16 Submit all appeal documentation within the relevant timescales.
17 Planning Inspectorate will issue a decision hopefully positive, which we will share with you.

Timeframe for planning to appeal.
For the planning applications made by a householder that has been refused for an extension to your house, conservatory, or outbuilding, you have 12 weeks to appeal from the date of the decision. The same time period applies to the refusal of a householder prior approval, as well as minor commercial applications.
In the case of refused planning applications(excluding householder and minor commercial applications), you have six months. An example of this would be applying for a new dwelling or a change of use to a House of Multiple Occupation (HMO). For advertisement consent applications you have 8 weeks from the date of the refusal to appeal, but for Certificate of lawful development (existing/proposed) applications, there is no time limit.

In my case, I instructed them after my planning application had been refused by our local planning office (RCT).
